Terms of Service

§1 Contractual Partner
On the basis of these terms and conditions (GTC) the contract is between the customer and

§ 2 Contract Conclusion

The contract is conducted exclusively via electronic commerce via the shop system. The presented offers represent a non-binding invitation to submit a bid through a customer order, which the provider can then accept. The order process for conducting the contract includes the following steps in the shop system:

  • Selecting the product and desired specifications (size, colour, number)
  • Placing selection in the shopping cart
  • Clicking the "order" button
  • Entering the billing and delivery address
  • Selecting payment method
  • Reviewing and processing of the order and all entries
  • Clicking the "buy now" button
  • Confirmation email confirming that the order has been received

The contract is concluded when the order confirmation is sent.

§ 3 Contract Period
The contract is concluded for an indefinite period.

§ 4 Retention of Title
The delivered merchandise remains the property of the provider until full payment is received.

§ 5 Rights Reserved
The provider reserves the right to render service of equal quality and price. The service shown in the shop is an example and not the individual, contractual service. The provider reserves the right to not provide service when unavailable.

§ 6 Prices, Shipping Costs & Return Shipment Costs
All prices are final and include the legal VAT. Sales to other EU countries are calculated net tax-free. Shipping is done by UPS.

The following shipping costs apply once per order:

  • Germany 6,90 Euro
  • Europe Zone 1 - 16,00 Euro (Belgium, Kroatia, Luxemburg, Netherlands, Austria, Poland, Czechia, Slovakia & Slovenia)
  • Europe Zone 2 - 20,00 Euro (Denmark, France, UK, Ireland, Monaco & Sweden)
  • Europe Zone 3 - 24,00 Euro (Bulgaria, Estonia, Finland, Greece, Island, Italy, Latvia, Lithuania, Portugal, Romania, Spain & Ungary)   
  • Europe Zone 4 - 42,00 Euro (Andorra, Guernsey, Liechtenstein, Norway & Switzerland)

 

  • In the case of partial deliveries, the free will only be applied once. There are no additional shipping costs. If there are cancellation rights, and the customer claims this, the customer shall bear the costs for returning the goods.

§ 7 Payment Terms
The customer has the following payment options: bank transfer in advance, invoice upon delivery & payment service providers like Paypal or Credit Card. Further payment methods are not available and shall be rejected.

The invoice amount is to be transferred in advance to the specified account after receipt of the invoice. The invoice contains all information needed for the transfer and is sent via e-mail. Using a trustee service/payment service provider, allows the provider and customer to process the payment amongst themselves. The trustee service/payment service provider forwards the customer payment to the provider. For more information, please consult the website of the respective trustee service/payment service provider. The customer is obliged to deposit or transfer the amount shown to the account indicated on the invoice, within 30 days upon receiving the invoice. Payment in full is due within 30 days from invoice date. The customer shall only be in default upon issuance of a warning notice.

§ 8 Delivery Conditions
The merchandise shall be shipped immediately after the receipt of the order. On average the shipment takes place the next day at the latest. The contractor obligates himself to delivery on the 3rd day after receiving the order. Delivery time is 3 days, unless otherwise stated in the item description. The provider shall ship the order from the warehouse, as soon as the entire order is in stock. The customer shall be immediately informed about delays. The provider has the right to withdraw from the contract if the supplier has a permanent hindrance to delivery, for which he is not responsible, in particular force majeure or lack of delivery from their own suppliers, even though a corresponding cover transaction was made. The customer shall be informed immediately. Any services received, in particular payments, shall be refunded.

§ 9 Warranty
Consumers have the right to a statutory warranty liability for the services offered, according to the relevant regulations stated in the German Civil Code (BGB). Exceptions to this warranty are based on the provisions stated in the General Terms and Conditions (GTC). If the customer is an entrepreneur, second-hand merchandise is excluded from the warranty. If the customer is a consumer, the warranty period for used merchandise is limited to one year. This does not apply to customer damage claims due to injury to life, limb, health or essential contractual obligations, which must be fulfilled in order  to achieve the contractual objective. In addition, this does not apply to damage claims due to gross negligence or intentional breach of duty by the provider, his legal representative or vicarious agent. In all other respects, the statutory regulations shall apply. 

§ 10 Contract Conditions
The customer has no direct access the stored contract text. The customer can correct input erros during the ordering process. In addition, he can proceed via Email.

You have the right to withdraw from this contract within 30 days without justification.
The cancellation period is 30 days from the day,

  • In the case of a purchasing agreement: in which the consumer or a third party other than the provider and indicated by the consumer, has or has taken possession of the merchandise.
  • In the case of a contract for several goods, in which the consumer has ordered as part of a single order, and which are delivered separately: in which the consumer or a third party other than the provider and indicated by the consumer, has or has taken possession of the merchandise.
  • In the case of a contract for the delivery of a product in several installments or pieces: where the consumer or a third party other than the provider and indicated by the consumer, has or has taken posseission of the last partial shipment or the last piece.
  • In the case of a contract for the regular delivery of merchandise for a fixed period of time: where the consumer or a third party other than the provider and indicated by the consumer, has or has taken possession of the first product.

When several alternatives meet, the las stand is decisive.

To exercise your cancellation rights, you must contact us by means of a clear statement (for example: letter or e-mail) about your decision to withdraw from this contract, at the following address:

You can use the attached sample cancellation form. However, this is not required.

The withdrawal term shall be deemed observed if the cancellation request is sent before the expiration of the cancellation period.

Cancellation Policy Effects
If you withdraw from this agreement, we are responsible for returning all payments received from you, including delivery charges (with the exception of any additional costs arising from your choosing a different delivery method than the standard delivery we offer) within 30 days from the date upon which your notification of withdrawal from this contract is received.

We shall reimburse you using the same method of payment used in the original transaction, unless otherwise agreed upon. You will not be charged any fees for reimbursement. We reserve the right not to reimburse you until the goods have been returned to us, or until you have provided proof that you have returned the goods, whichever is first.

You are responsible for returning the goods to the following address immediately, and no later than 30 days from the date on which you inform us of the withdrawl from this contract:

The deadline is met if you send the goods before the expiration of 30-day period.

Your bear the immediate costs of returning the goods. You only have to pay for a possible depreciation in value of the goods, you shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to ascertain the nature, characteristics and functionality of the goods.

End of Cancellation Policy

Disclaimer
Customer claims for damages are excluded for the following reasons, unless otherwise stated. This also applies to the representative and vicarious agents of the provider, if the customer raises these claims for damages. Claims for damages due to injury to life, limb, health or essential contractual obligations, which must be fulfilled in order to achieve the contractual objective are excluded. In addition, this does not apply to claims for damages due to gross negligence or intentional breach of duty by the provider, his legal representative or vicarious agent.

Non-assignment Clause and Pledge Ban
Claims or rights of the customer against the provider may not be assigned or pledged without consent of the provider, unless the customer has demonstrated a legitimate interest in the assignment or pledge.

Language, Jurisdiction and Applicable Law
The contract is written in German. The further implementation of the contractual relationship takes place in German. Only laws of the Federal Republic of Germany apply.

This applies to consumers only insofar as no statutory regulations are limited in which the customer resides or ordinarily resides. The place of jurisdiction for disputes with customers, who are not consumers, legal entities of public law or special funds under public law, is the registered office of the provider: Hamburg / Germany.

Data Protection
In connection with the initiation, conclusion, settlement and reversal of a purchase contract based on these terms and conditions, the provider collects, stores and process data. This takes place in accordance with legal regulations. The provder does not pass personal data of the customer on to third parties, unless obliged to do so by law, or the customer has previiously expressed consent. If a third party is used for services in connection with the execution of processes, the Federal Data Protection Act regulations shall be complied with. The data provided by the customer by way of ordering will be processed solely to establish contact within the framework of the contract, and only for the purpose for which the customer provided the data. The data shall only be forwarded to the shipping company responsible for the delivery of the goods as required. The payment details shall be forwarded to the bank responsible for the payment. Insofar as the provider meets retention periods of commercial or tax laws, some data could be stored up to ten years. During the visit to the provider´s internet shop, anonymized data, which does not allow or enable the identification of personal data, in particular IP address, date, time, browser typ, operating system and visited page, are logged. At the customer´s request, personal data will be deleted, corrected or blocked within the scope of the legal requirements. Information about all of the customer´s personal data is available, free of charge. The customer can contact the provider about questions, requests for deletion, correction or blocking of personal data, as well as questions regarding collection, processing and use, at the following address:

Severability clause
The invalidity of a provision of these GTC (General Terms and Conditions) shall not affect the validity of any other provision of the agreement.
